LEGAL NOTICE AND TERMS OF USE OF THE DroneSky HR application

This page contains the legal notice and terms of use of the DroneSky HR mobile application.

By using the DroneSky HR application, the user confirms that they are familiar with this legal notice and these terms of use and that they accept them.

This document supplements the general terms of use and data protection rules published on the Saluto‑Team j.d.o.o. website, available at the address https://saluto-team.hr/uvjeti-koristenja-zastita-podataka/.

1. Publisher

The DroneSky HR application is owned and fully developed by Saluto‑Team j.d.o.o., Benaši 16, 51216 Viškovo, Croatia, registered in the court register of the Commercial Court in Rijeka under MBS: 040334040, VAT ID (OIB): 63624119122, with share capital of EUR 1.33 paid in full.

The founder and shareholder is Tomislav Ćuto, who also acts as Managing Director and is authorized to represent the company.

2. Nature and purpose of the application

DroneSky HR is an informational mobile application designed for planning unmanned aircraft system (UAS/drone) flights and assessing operational flight conditions, providing users with data on weather conditions, airspace, restrictions, and other relevant information. The application does not constitute an official source of aeronautical information and is not a substitute for official systems and publications of the competent authorities.

3. No official source of aeronautical information

The information available in the application, including data on weather, airspace, geographical zones, restrictions, warnings, and other elements of the operational situation, is provided for information purposes only. The application does not replace official sources such as AIP, AIC, NOTAMs, AIM Portal, AMC Portal Mobile and other official channels of Croatia Control Ltd. (HKZP), the Croatian Civil Aviation Agency (CCAA) and other competent authorities.

Before each operation, the user is obliged to consult official information sources and comply with their instructions and limitations.

The displayed data may differ from the actual situation due to update delays, errors in data sources or technical limitations and must not be used as the sole basis for operational decision‑making.

        3.a Use of location data

The DroneSky HR application uses the device’s location data solely for the purpose of displaying weather conditions, visibility and other information relevant to drone flights at the selected location.

The user may deny access to location services in the device settings; in that case some functions of the application may be limited (e.g. automatic location detection), but the application can still operate with manual selection of the area of interest.

Location data is not used for tracking users for marketing purposes and is not shared with third parties, except with weather data providers and other technical service providers, to the extent necessary for displaying information in the application.

4. Responsibility of the operator and remote pilot

The user of the application (UAS operator and/or remote pilot) is at all times solely responsible for planning, preparing and conducting the flight, including:

•  compliance with UAS geographical zones and all airspace restrictions

•  checking applicable regulations, local rules and special flight conditions

•  checking current meteorological conditions and their suitability for the planned operation

•  the technical condition of the unmanned aircraft and associated equipment

•  compliance with safety rules, protection of people and property on the ground, and environmental protection.

Use of the application does not release the user from the duty to act in accordance with the laws of the Republic of Croatia, Regulation (EU) 2019/947, the related implementing acts and EASA guidance, as well as the rules of the competent authorities.

5. Aerial imaging and use of aerial footage (DGU)

For aerial imaging and the use of aerial footage in the territory of the Republic of Croatia, prior approval of the State Geodetic Administration (DGU) is required in certain cases, including approval for imaging and approval for the use or publication of the recorded material.

The user is solely responsible for checking the applicable regulations and, where necessary, requesting the appropriate approvals via DGU’s official channels before recording and publishing photo/video content.

The user must also observe the regulations on privacy and personal data protection, as well as prohibitions/restrictions on imaging certain facilities, infrastructure or areas. By publishing footage in which persons or property can be identified, the user assumes full responsibility for compliance with the relevant regulations.

6. Limitation of liability of Saluto‑Team j.d.o.o.

Saluto‑Team j.d.o.o. makes reasonable efforts to ensure that the information in the application is accurate and up to date, but does not warrant that all data are at all times complete, correct, error‑free or fully aligned with the current situation in space and time.

To the maximum extent permitted by applicable law, Saluto‑Team j.d.o.o., its founders, members, directors and associates shall not be liable for any direct or indirect damage, loss, regulatory violations, offences, criminal penalties, safety incidents or other consequences that may arise as a result of:

• reliance on data displayed in the application

• use of, or inability to use, the application

• decisions made by the user when planning or conducting UAS operations.

7. Licence to use and prohibitions

The user is granted a limited, non‑transferable and non‑exclusive right to use the DroneSky HR application on their own devices, solely for the purposes for which the application is intended.

The user is not permitted to:

• decompile, modify, adapt or otherwise alter the application’s source code
• circumvent technical protection measures or usage restrictions
• use the names, logos, visual identity or content of the application without authorization in a way that may mislead as to the identity of, or affiliation with, the publisher.

8. Data processing, analytics and privacy protection

The application may collect certain technical and usage data (for example device information, operating system version, language settings, anonymous usage statistics, etc.) in order to ensure functionality, improve performance and perform analytics, for example through tools such as Firebase Crashlytics and TelemetryDeck. Any processing of personal data, if and to the extent it is carried out, takes place in accordance with the General Data Protection Regulation (GDPR) and applicable national legislation.

To improve stability and understand how the application is used, DroneSky HR uses TelemetryDeck – an anonymous analytics tool compliant with European data protection rules. TelemetryDeck records aggregated technical data such as the frequency of opening the application and individual screens (e.g. map, weather conditions, flight planning), the app and operating system versions, and device type. We do not collect flight content, user location, personal data (name, email, contact details) or other information that would directly identify an individual user; the data is used solely to analyse usage and improve the application.

In the event of an app crash, Crashlytics may collect technical crash data (such as stack traces, app version, device model and operating system version) for diagnostic and debugging purposes. This data does not include the user’s name, email address or other identifying information.

Usage data and technical diagnostic data are processed in aggregated and/or pseudonymised form, are not used to profile individuals, and are not used for advertising.

The categories of data that the application may collect and the purposes of their processing are further described in the App Store Privacy “Nutrition Label” section on the application’s page in the Apple App Store.

In the event of any discrepancy between the summary in the Privacy Label and these terms, the provisions of this document and the general data protection terms of Saluto‑Team j.d.o.o. shall prevail.

9. Changes to this legal notice and terms of use

Saluto‑Team j.d.o.o. reserves the right to amend this legal notice and the terms of use of the DroneSky HR application at any time. The updated version will be published on this page and, where necessary, additionally indicated within the application itself. You are advised to check this page periodically to stay informed about any changes.

10. Applicable law and jurisdiction

This legal notice and the terms of use are governed by the laws of the Republic of Croatia. Any disputes shall be subject to the jurisdiction of the court having subject‑matter jurisdiction at the registered seat of Saluto‑Team j.d.o.o., unless mandatory rules provide otherwise.
